These Terms explain the rules for using Foodlio. Foodlio is a community connection platform that helps buyers discover independent food sellers. We do not make, inspect, deliver, own, endorse, or guarantee the food or services listed by sellers.
1. Acceptance
By accessing or using Foodlio, you agree to these Terms. If you do not agree, do not use the app. You are responsible for making sure your use of Foodlio is lawful in your location.
2. Foodlio's Role
Foodlio is a listing, discovery, and communication tool for community food activity. Foodlio is not a restaurant, caterer, retailer, food manufacturer, distributor, delivery provider, payment processor, health inspector, agent, broker, employer, or representative of any seller or buyer.
- Sellers are independent people or businesses responsible for their own listings, products, pricing, availability, hygiene, permits, taxes, fulfilment, refunds, and customer service.
- Buyers decide for themselves whether to contact, order from, meet, pay, collect from, or accept delivery from a seller.
- Any transaction, arrangement, conversation, payment, collection, delivery, refund, substitution, or dispute is between the buyer and seller unless Foodlio expressly says otherwise in writing.
3. No Food Safety Warranty
Food can carry health risks, especially for people with allergies, intolerances, medical conditions, pregnancy, compromised immune systems, children, or elderly people. Foodlio does not inspect kitchens, verify ingredients, test products, confirm storage conditions, certify allergen controls, or guarantee that any food is safe, lawful, accurately described, suitable, fresh, available, or fit for a particular purpose.
Buyers must ask sellers directly about ingredients, allergens, preparation methods, handling, storage, permits, dietary suitability, and any other concerns before buying or consuming anything.
4. Seller Responsibilities
Sellers are solely responsible for everything they list, say, sell, prepare, package, deliver, and charge for.
- Sellers must comply with all applicable laws, food safety rules, labelling rules, licensing or permit requirements, tax obligations, consumer protection obligations, and local bylaws.
- Sellers must provide honest, current, and complete information about products, prices, availability, allergens, ingredients, delivery terms, collection terms, and refunds.
- Sellers must not list illegal, unsafe, misleading, counterfeit, prohibited, recalled, contaminated, or misrepresented goods.
- Sellers must handle buyer personal information lawfully and only for the order or communication purpose for which it was shared.
5. Buyer Responsibilities
Buyers use Foodlio at their own discretion and risk.
- Buyers must check seller information, ask questions, confirm pricing and collection or delivery details, and use reasonable judgment before ordering.
- Buyers are responsible for disclosing allergies, dietary needs, delivery constraints, and other important requirements directly to the seller.
- Buyers must not misuse the app, harass users, make false claims, attempt chargeback abuse, or place orders they do not intend to honour.
6. Payments, Refunds, Delivery, and Disputes
Unless Foodlio later provides an in-app paid feature with separate terms, Foodlio does not process payments, hold funds, guarantee refunds, provide escrow, arrange delivery, or insure transactions. Payment, refund, delivery, pickup, cancellation, and replacement terms are agreed directly between buyer and seller.
Foodlio may provide communication tools or order records, but any dispute remains between the buyer and seller. Foodlio may, at its discretion, remove listings, restrict accounts, or share available records where legally required or where needed to protect the community.
7. Featured Sellers and Promotions
Foodlio may later offer featured placements, paid visibility, advertising, or promotional tools. If we do, pricing and additional terms will be shown before purchase. Featured placement will not mean Foodlio certifies, guarantees, inspects, endorses, or accepts responsibility for a seller or their products.
8. User Content
You are responsible for listings, photos, messages, reviews, profile content, and other content you submit. You give Foodlio permission to host, display, format, copy, and use that content to operate, secure, improve, market, and support the app. You must have the right to upload anything you provide.
Foodlio may remove content or suspend accounts that appear unlawful, unsafe, misleading, abusive, discriminatory, infringing, spammy, or harmful to the app or community.
9. Account Security
You are responsible for your account activity and for keeping your login access secure. Tell us promptly if you believe your account has been accessed without permission.
10. Availability and Changes
Foodlio may change, pause, restrict, or stop any part of the app at any time. We may update these Terms when the app changes, when laws change, or when we need clearer rules. Continued use after an update means you accept the updated Terms.
11. Disclaimers
Foodlio is provided as is and as available. To the maximum extent allowed by law, Foodlio disclaims all warranties, representations, guarantees, and conditions, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, quality, safety, legality, reliability, and uninterrupted operation.
12. Limitation of Liability
To the maximum extent allowed by law, Foodlio and its owners, operators, employees, contractors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or similar damages, or for loss of profits, revenue, data, goodwill, food, opportunity, or business, arising from or connected to Foodlio, any seller, any buyer, any listing, any product, any delivery, any collection, any payment, any dispute, or any third-party service.
To the maximum extent allowed by law, Foodlio's total liability for any claim connected to the app will be limited to the greater of the amount you paid directly to Foodlio for the specific feature giving rise to the claim in the previous three months, or ZAR 100. Some laws may not allow certain exclusions or limits, so the limits apply only as far as the law permits.
13. Indemnity
You agree to defend, indemnify, and hold Foodlio and its owners, operators, employees, contractors, and service providers harmless from claims, losses, liabilities, damages, costs, and expenses arising from your use of Foodlio, your content, your products, your orders, your breach of these Terms, your breach of law, or your dealings with another user.
14. Governing Law
Unless mandatory law says otherwise, these Terms are governed by the laws of South Africa. Courts or consumer bodies with lawful jurisdiction may still apply mandatory protections that cannot be excluded.
